In the January 6, 2013 edition of The National Law Journal, Sherman Silverstein shareholder Alan Milstein wrote about the legal and bioethical issues surrounding the difficult topic of determining when death occurs.
The article focused on two tragic cases recently in the news. At a hospital in Oakland, California, Jahi McMath, 13, underwent a tonsillectomy to cure her sleep apnea. A terrible chain of events led to her being declared brain dead. About a week before this incident, Erick Munoz found his wife Marlise, who was 14 weeks pregnant, unconscious and unresponsive on the floor. She too was declared brain dead. Both Erick and his wife were paramedics and had agreed neither would want to be sustained by machines if they were suffering from a condition without hope of recovery. A Texas state law regarding pregnant patients prohibited the ventilator to be disconnected.
Milstein tackled the issue of what legal or ethical obligation does a physician have to treat the dead in this timely, informative and heart-breaking opinion piece. CLICK HERE TO READ.Abramowitz, Poslusny Bring Bankruptcy Practice to Sherman Silverstein
